Marion County restaurant inspections: July 17

The following restaurant inspections with critical violations were conducted by Marion Public Health between July 17 and July 31:

Pastimes, 115 N. Elm St., Prospect, July 17. Food employee(s) not washing hands in approved handwashing sink or automatic handwashing facility (critical). Observed person in charge (PIC) wash hands in three-compartment sink with no warm water. TCS foods not being cold held at the proper temperature (critical, corrected during inspection). Observed milk in the small Coca Cola refrigerator at 48 degrees. Refrigerated, ready-to-eat, TCS foods not properly date marked (critical, corrected). Coney sauce dated July 25 made on July 17 should have a date of July 23, the day it was made. Manual wash solution not being maintained at 110 degrees or above (critical repeat).

Denny's #8161, 1050 Mt. Vernon Ave., Marion, July 19. PIC did not ensure employees are properly maintaining temperatures of TCS foods during hot and cold storage (critical). Observed multiple cold storage food items outside proper temperature. Food not properly protected from contamination by separation, packaging and segregation (critical repeat). Observed food not properly covered during storage. Food equipment surfaces not cleaned at required frequency (critical). Equipment food-contact surfaces or utensils are unclean (critical). Observed multiple areas where food contact surfaces had a build-up of debris. Cooling - temperature and time control (critical, corrected during inspection).

Observed improper cooling of TCS food. PIC discarded food items. TCS foods not being cold held at the proper temperature (critical, corrected). Observed TCS foods in multiple coolers, including the walk-in, upright and prep coolers, were outside proper temperature. PIC discarded all food items. Raw shell eggs not maintained at 45 degrees or below (critical). Observed raw shell egg temperatures in the walk-in and upright coolers to be outside of proper temperature. PIC discarded raw shell eggs. Refrigerated, ready-to-eat, TCS foods not properly date marked (critical, corrected). Observed TCS food not properly date marked. PIC discarded affected food. Presence of live insects, rodents, and other pests (critical). Observed live flies.

Penn Station, 158 McMahan Blvd., Marion, July 19. Unsafe, adulterated or not honestly presented food not discarded or properly reconditioned (critical, corrected during inspection). Observed damaged can of artichokes. PIC discarded the can.

The Remnant Tea and Coffee LLC, 123 W. Church St., Marion, July 20. Ready-to-eat, TCS food not properly discarded when required (critical, corrected during inspection). Observed a date marked food item not discarded when required. PIC discarded the food item.

J.C.'s Pizza, 11 S. High St., LaRue, July 20. Presence of live insects, rodents, and other pests (critical, corrected during inspection). Observed a few live flies. PIC was advised to hire a pest control service for persisting issues.

Andrew's Pastry, 1282 Delaware Ave., Marion, July 24. PIC not ensuring employees are properly sanitizing equipment and utensils and monitoring of sanitizer parameters (critical, corrected during inspection). Observed that the facility is not properly sanitizing cleaned dishes. PIC was re-trained on the process and reminded of the requirements. Employees are not informed in a verifiable manner of their responsibility to report information about their health (critical, corrected).

Did not observe a sick policy at the facility. PIC was given copies of the MPH sick policy for employees to review and sign. Food not properly protected from contamination by separation, packaging and segregation (critical, corrected). Observed ready-to-eat foods not properly covered. Insufficient air gap between the flood rim and the water supply inlet (critical, corrected). Observed bottom of water hose within the flood rim of the mop sink. PIC removed the hose from the mop sink.

Arby's #904, 1314 Delaware Ave., Marion, July 24. TCS foods not being cold held at the proper temperature (critical, corrected during inspection). Observed some food items outside the required cold holding temperature. PIC disposed of affected food accordingly. Presence of live insects, rodents and other pests (critical, corrected). Observed live flies. PIC was advised to contact their pest control company with persisting issues. Insufficient air gap between the flood rim and the water supply inlet (critical, corrected). Observed end of water hose within the flood rim of the mop sink. PIC shortened the water hose during the inspection.

Burger King Restaurant #1059, 1245 Delaware Ave., Marion, July 24. Quaternary ammonium sanitizing solution at incorrect temperature, concentration, and/or water hardness (critical, corrected during inspection). Observed incorrect concentration of sanitizer for manual warewashing. PIC determined there was an issue with the sanitizer dispensing system and is having employees mix the sanitizer manually until repairs are made to the dispensing system. Insufficient air gap between the flood rim and the water supply inlet (critical, corrected). Observed end of water hose within the flood rim of the mop sink. PIC removed the hose from the mop sink.

A Taste of Memphis, 138 S. Main St., Marion, July 25. PIC unable to demonstrate knowledge of temperatures and times for cooling and reheating (critical, corrected during inspection). PIC was unable to state time and temperature requirements for cooling and re-heating. PIC was re-trained. Quaternary ammonium sanitizing solution at incorrect temperature, concentration and/or water hardness (critical repeat, corrected).

Observed incorrect concentration of sanitizer for manual warewashing. PIC determined there was an issue with the sanitizer dispensing system and is using sanitizer tablets in the interim. TCS foods not being hot held at the proper temperature (critical). Observed some food items not being hot held at the proper temperature. TCS foods not being cold held at the proper temperature (critical). Observed some food items not being cold held at the proper temperature.

Topped Ice Cream, 127 S. Main St., Marion, July 25. PIC unable to demonstrate knowledge of temperatures and times for safe refrigerated food storage, hot holding, cooling and reheating (critical, corrected during inspection). PIC was re-trained on the process. Food employee(s) did not wash hands when required (critical, corrected). Did not observe food employee washing hands prior to donning gloves. Food employee was re-trained. Refrigerated, ready-to-eat, TCS foods not properly date marked (critical repeat, corrected). Observed some food items not properly date marked. Presence of live insects, rodents and other pests (critical, corrected). Observed live gnats. PIC was advised to contact a pest control company for persisting issues.

Certified Oil Company #289, 976 E. Center St., Marion. July 26. Handwashing sink not accessible (critical, corrected during inspection). Observed items sitting in both handwashing sinks. Food not properly protected from contamination by separation, packaging and segregation (critical repeat, corrected). Observed ready-to-eat apples not wrapped. PIC will contact fruit vendor to wrap washed apples. TCS foods not being cold held at the proper temperature (critical, corrected). Observed prep table cooler not at the proper cold holding temperature. PIC discarded all affected food items and put in work ticket for cooler repair.

Domino's Pizza #2331, 538 E. Center St., Marion, July 26. Food not properly protected from contamination by separation, packaging and segregation (critical, corrected during inspection). Observed pizza sauce container not covered between use. Insufficient air gap between the flood rim and the water supply inlet (critical, corrected). Observed end of water hose within the flood rim of the mop sink. PIC removed the water hose from the mop sink.

Pizza Brothers, 617 Delaware Ave., Marion, July 27. Improper bare-hand contact with RTE foods (critical, corrected during inspection). Observed food employee having bare-hand contact with ready-to-eat foods. Food employee was re-trained on handling requirements.

The Wyndmoor of Marion (OH) LLC, 308 Barks Road E., Marion, July 27. Presence of live insects, rodents, and other pests (critical, corrected during inspection). Observed live flies. PIC was advised to contact their pest control company for persisting issues. Food contact surfaces not easily cleanable (critical, corrected). Observed cutting board with deep score marks. PIC discarded cutting board. Insufficient air gap between the flood rim and the water supply inlet (critical, corrected). Observed end of water hose within the flood rim of the mop sink. PIC removed water hose from the flood rim.

GAAL LLC dba Three Sticks Golf Course, 3594 Gooding Road, Marion, July 28. Packaged food not properly labeled (critical). Receiving subs from VFW who is not currently licensed to do so with the Ohio Department of Agriculture. PIC told to not sell the subs until the VFW is properly licensed. Refrigerated, ready-to-eat, TCS foods (subs) not properly date marked (critical). Marked made on July 23, use by July 30. Day made counts as day 1. Subs are from an unapproved source and are to be not sold at the facility until the proper licensing is obtained from the sub provider.

6-7-1 Home Inc., 1232 E. Center St., Marion, July 31. Food contact surfaces not easily cleanable (critical, corrected during inspection). Observed cutting board with deep score marks. Cutting board was discarded.

Fairpark Duchess Shoppe #1221, 440 E. Fairground St., Marion, July 31. Handwashing sink not accessible (critical, corrected during inspection). Observed items sitting in handwashing sink. Food in contact with an unclean surface or linens (critical, corrected). Observed unpackaged TCS foods on visibly unclean surface. PIC discarded contacted food. TCS foods not being hot held at the proper temperature (critical repeat, corrected). Observed some food items not hot held at the proper temperature. PIC discarded affected food items. Refrigerated, ready-to-eat, TCS foods not properly date marked (critical repeat, corrected). Observed food item missing a date mark. Presence of live insects, rodents and other pests (critical, corrected). Observed live flies. PIC was advised to contact a pest control company for persisting issues.
